TERMS AND CONDITIONS

Please ensure you read and understand the following terms & conditions. If you have any queries please do not hesitate to contact us for clarification before you sign the booking form.

Sunshine Dream Villa is a privately owned villa owned by Alistair & Jocelyn McIntyre, herein after called 'The Owners'. Our management company, herein after referred to as ‘The Management Company’ manages the villa locally on our behalf.

1.    WHAT’S INCLUDED:  The guest has the use of the property including all utilities except pool and spa heating, for which a supplement is payable.

The maximum occupancy is 12 adults.

The villa is cleaned and prepared for your arrival. It will be available from 4pm local time on your arrival day. We ask that you vacate the villa by 10am on the day of your departure, leaving it in a tidy condition to enable the cleaners to start work.

2. YOUR BOOKING:  Bookings are valid after:

  • the completed and signed booking form is received by the owners
  • the appropriate deposits have been paid, and
  • the owners have confirmed the booking in writing.

The person who signs the booking form certifies that these terms and conditions are accepted on behalf of all members of the party, including those substituted or changed at a later date. The signatory must be a member of the party and be 21 years old or over. Bookings cannot be accepted from parties of young people less than 21 years of age. Due to Florida State fire regulations the maximum occupancy, as stated by us, must not be exceeded.

A non-refundable deposit of 20% of the total booking cost must accompany the booking form. A higher deposit may be required for bookings exceeding three weeks.

No further reminders will be issued, therefore it is the guest’s responsibility to note the balance due date.

3. PAYING THE BALANCE:  The balance of your rental cost is payable 10 weeks prior to your arrival at the villa along with a security deposit of £200/$350. Where payment in full has not been made by this date, we reserve the right to cancel the booking and cancellation charges as detailed below will apply. If you book within 10 weeks, we will require full payment at the time of booking.

4. CANCELLATION: If the guest cancels for any reason, the owners should be advised immediately in writing. The owners shall be entitles to recover the following charges:-

    Up to 10 weeks before departure                                        Loss of deposit only

    40 to 60 days before departure                                           Loss of 70% of total amount

    0 to 39 days before departure                                             Loss 0f 100% of total amount

 

 

5. SECURITY DEPOSIT:   We understand that accidents do happen, but we do ask that you:

  • replace to the same standard any breakages or losses (the management company will be the  sole arbitrator)
  • inform our management company of any defects or breakages as soon as possible
  • permit the management company reasonable access to the property to carry out repair or emergency maintenance.

 

A security deposit of £200/$350 must be deposited with the owners or their management company prior to being granted access to the villa. This is to cover the owner against any loss or damage to the villa by the guest, members of their party or invitees of the guest. This deposit will be refunded to the guest within 21 days after the completion of the holiday providing all keys are returned and no loss or damage is reported by the management company. If damage or loss is reported that costs in excess of the security deposit lodged, the owner reserves the right to reclaim from the guest any costs incurred in rectifying the damage. 

In the event of a cheque not being honoured by the bank on which it is drawn we will make a charge of £15/$25 to cover the bank and our administration costs.

 

6. USE OF POOL:  The pool is chemically cleaned and balanced every week for your safety and comfort; however on rare occasions it may be necessary to apply extra which may make it necessary to be out of the pool for 12 –18 hours. Guests may use the pool at their own risk but please observe the safety notices.

If pool heating has been ordered it will be switched-on on the day ordered. The pool heater is a mechanical device and in the rare event of breakdown every attempt will be made to repair the pool heater as quickly as possible. The owner shall refund costs equivalent to those days on which the pool heating is unavailable.

The pool heater must only be switched on and off by a technician authorised by the owner. The guest must not tamper with, interfere with, or attempt to change any of the pool heater settings. Any attempt to do so will render the booking void, all monies paid will be forfeited and all occupants will be asked to leave the villa immediately with no further compensation.

 

7. NO SMOKING POLICY:  We have strict NO SMOKING policy inside the house but you are welcome to smoke on the pool deck using the ashtrays provided. If the management company find any evidence of smoking inside the house during your stay this will constitute a serious breach of contract and you will be evicted immediately. All monies paid will be forfeited and you will be liable for a deep clean fee of all soft furnishings, linens and carpets.

 

8. CODE OF CONDUCT:  Solana is a residential community; in order to ensure that all residents and visitors are not disturbed please do not play loud music or be noisy in the pool between the hours of 10.30pm and 7am. Commercial vehicles, campers, mobile homes or boats are not permitted to be parked on the property.

 

9. SECURITY & SAFETY:  To comply with state fire regulations under no circumstances may more than the maximum number of persons identified on the booking form occupy the property. Ensure all windows and doors, including the one into the garage are locked securely before leaving the property or retiring for the night.

It is a condition of booking that the fitted, monitored alarm must be used when the house is empty.

At no time must the patio door alarm be tampered with.

 

10. COMPUTER USE:   A broadband internet connection is provided free for guests. The owners will endeavour to ensure that this service is available for use but cannot be held responsible for any failures of communication lines due to our ISP performing maintenance or repairs.

 

11. INSURANCE:  It is strongly recommended that guests have adequate insurance for all members of their party that cover them for cancellation fees, medical bills and any other losses which may occur.

12. PASSPORTS:  ALL BRITISH CITIZENS REQUIRE A FULL PASSPORT VALID FOR A PERIOD OF AT LEAST 90 DAYS BEYOND THE HOLIDAY RETURN DATE.

It is the guest’s responsibility to make sure that everybody has the correct documentation for travelling. We cannot accept liability for any of the above or any refusal of passage.

13. IF WE CHANGE YOUR ACCOMMODATION: In the unlikely event that it is necessary to cancel your booking we reserve the right to do so and will only be liable to refund monies paid. We will inform you as soon as possible. We do however belong to an informal homeowners’ association and will make every effort to find you a similar property on the same community resort.

14. FORCE MAJEURE:   No liability can be accepted for events, which are 'force majeure'. These include, but are not limited to war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural or nuclear disaster, fire, adverse weather conditions or other events outside our control.

 

15. LIABILITY:   ‘The Owners’ or ‘Management Company’ accept no liability whatsoever for any injury, death, or damage or loss however caused, as a result of the booking and/or the subsequent holiday. This extends to any other visitor to the villa or swimming pool area, or for any loss or damage caused to any belongings brought to the premises. The owner does not accept any liability for any such claim by a third party as a consequence of actions by the clients occupying the villa during the period of the let.

No liability is accepted by the owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the owner. 

16. PROMOTIONAL MATERIAL:   Our web site and brochures are a guide to the quality and description of our villa and  facilities. We cannot always guarantee that all these are available due to changes or damage; we would obviously try to inform you of these.

17. DISPUTES:  In the event of any dispute between owners and guests:

Such a dispute will be submitted to mediation in England before resorting to arbitration or litigation. The parties shall agree a mutually acceptable mediator and will share the cost equally.

This agreement is governed by English Law in reference to interpretation and performance, and in any action arising out of this contract English Law will govern and exclusive jurisdiction is conferred on the English courts.
